The Court of Appeal sitting in Calabar has today 13 November, affirmed the re-election of Governor Udom Emmanuel of the PDP in the March 9 governorship election.

Udom defeats APC’s Candidate, Obong Nsima Ekere in a petition filled to upturned the decision of the Election Tribunal that gave Udom victory.

Recalled that the Tribunal delivered judgement on September 5, at Uyo had dismissed Ekere’s Petition for lack of merit.

Delivering judgement on the issue, the five-man panel affirmed the ruling of the lower court.

The Appellate Court also affirmed the decision of the Tribunal, rejecting a the document filed by Nsima Ekere because they were all public documents and should not be used as an official document in the court.

The Court rule that out of the results of twenty-one (21) Local Government Areas challenged, the Petitioner did not lead any evidence in proof of their case in eight (8) and led very scanty evidence which on cross-examination were rendered very impotent in the other Local Governments were they made any effort to prove their claims.

However, the court affirmed the Victory of His Excellency, Mr Udom Emmanuel as the Governor of Akwa Ibom State from the elections held on March 9, 2019, and awarded the cost of 500,000 naira in favour of the First Respondent to be paid by the Appellants. The lead judgement was affirmed by all the other justices of the Court of Appeal.

Therefore, Nsima Ekere is to pay the sum of N500,000 to Udom Emmanuel.
