Prince Dapo Abiodun wins the last Court Case on his eligibility to contest as governor.
The governor of Ogun state, Prince Dapo Abiodun has recorded another victory as the Federal High Court sitting in Abuja has struck out another case seeking his disqualification as the Ogun governorship candidate of the All Progressive Congress in the 2019 guber election.
Mrs. Iyabo Anisulowo, filed pre-election suit against the Party’s candidate, Prince Abiodun challenging his eligibility as a candidate at the election over his alleged failure to participate in theNYSC Scheme National Youth Service Corps.
Counsel to the Ogun State Governor, Mr Wale Abeeb Ajayi, had prayed the court to dismiss such case against his client because such claime is not known in the law.
He argued that participation in the NYSC scheme was never a disqualification factor in elections in Nigeria.
Justice M. A. Mohammed on Wednesday while delivering his judgment, stated that the plaintiff did not establish that Dapo Abiodun presented false or fake academic certificates to the Independent National Electoral Commission (INEC) but another issue that is not cited in the law.
The Judge held that a candidate cannot be disqualified over failure to participate in the NYSC scheme, saying that ‘a candidate can only be disqualified under Section 177 of the Constitution.’
Justice Mohammed dismissed the case for lack of merit.
