2019 Election: Finally, Atiku, PDP file petition against APC, INEC, challenging Buhari’s reelection

The Peoples Democratic Party’s Presidential candidate has finally filed petition against President Buhari on his re-election. 19 days after the declaration of President Muhammadu Buhari as winner of the February 23, presidential election by the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP) presidential candidate, Atiku Abubakar and his party have finally filed petition challenging Buhari’s re-election.

Atiku and his party are challenging Buhari’s reelection on the grounds of alleged massive rigging, malpractices and non compliance with our electoral laws .

The party and its presidential candidate, Atiku Abubakar, have gathered a team of lawyers at the Court of Appeal, venue of the presidential election tribunal who are currently working on the processes of filing the petition.

Mr Abubakar has since rejected the result of the February 23 polls, alleging rigging. He vowed to contest the outcome of the election in court.

Earlier, a court approved the PDP’s application to be allowed access to materials used for the election. The court however blocked the party’s move to have the materials forensically examined.

On Monday 18, Alhaji Atiku Abubakar’s lead lawyer, Chris Uche, told journalist that the processes were being filed.

In the filed petition this on Monday 18th of March, main part of the prayers was for Atiku to be declared winner of the February 23 presidential election.

They prayed alternatively that the Presidential Election Petition Tribunal (PEPT) nullify the poll and order for a fresh election that will be conducted in line with the provisions of the electoral laws.

Respondents in the suit are the All Progressives Congress, APC, Buhari and INEC.

Although a copy of the petition cannot be obtained at the time of filing this report, but the PDP National Legal Adviser, Emmanuel Enoidem, confirmed to journalists at the Court of Appeal, venue of the PEPT that the petition has been filled.

Bar. Emmanuel Enoidem said that the PDP and its presidential candidate Atiku Abubakar have already assembled a powerful legal team, comprising 20 Senior Advocate of Nigeria SANs and other retinue of lawyers who will establish the fact of the petition.

He also disclosed that over 400 witnesses have been assembled to testify during the hearing of the petition. On the order earlier granted to the party and its presidential candidate to inspect materials, he said that the inspection is being carried out from the polling units across the country.

Mike Ozekhome, SAN, further affirmed that the petition filed by the Peoples Democratic Party and Alhaji Atike Abubakar was strong, solid and unassailable.
